ben stokes is in trouble after a fight 2 30 am in the morning
and been arrested
should he stay or go for the ashes series ?

Harsh on Buttler but I'd maybe leave him out for now. He's in for his batting and not scoring. Stokes gives us another option with the ball.

Back in the squad but his punchy antics have allowed Sam Curran and Chris Woakes to impress in his place.
Not sure you could argue that either of them deserves to be left out for him … Curran MOTM in Test 1 & Woakes at Lords.

Based on the questions the juries had to ask themselves in order to make their decision no real surprise they found him not guilty.

Common sense says that he went beyond defending himself (or someone else) and that he was probably guilty. Whether it was assault or affray is a mere technicality: for affray you don't have to prove lack of consent, so is the obvious charge when the alleged victim is not giving prosecution evidence. On every post I have made since last year I have said that Stokes would be acquitted, because juries are overly impressed by a defendant who has made something of his life, and are unwilling to disrupt that with a conviction. Multiply that by 10 in the case of a national sporting hero.

different rules for football lads mate..has been since 1988.

a few yrs football banning order each and likely custodial and criminal record for these two if they were football lads..

known plent WH and others that have been put behind the door for less than this

If anyone bothers to read the verdict on BBC, Stokes was charged with affray not assault.

If you can get your head round that, then the decision makes sense.

I've backed India to lose 5-0, so this might help.

Presumably not available while the ECB decide whether to charge him.
Should be able to decide that by the end of the year and set a hearing for around June 2019.
Definitely will be able announce that verdict around the end of September 2019.

At least we now have a definition of affray.
Or at least what it’s not. Pursuing a bloke down the street as he backs off and punching him to the ground ISNT affray.
Should keep all these minor street brawl cases out of the courts then.
